The Local Human/Do Good Foundation Essay Contest

1.PROMOTION DESCRIPTION: The Local Human/Do Good Foundation Essay Contest (the “Contest”) begins on or about November 16, 2020 at 12:01 a.m. pacific time (“PT”) and ends on or about 4:59 p.m. PT on November 27, 2020 (the “Entry Period”). By participating in the Contest, each entrant (and any minor entrant’s parent or legal guardian) unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Local Human, LLC and The Do Good Foundation(“Sponsor”), which shall be final and binding in all respects.
2.ELIGIBILITY: This Contest is open only to legal residents of the state of California who are at least thirteen (13) years of age and are current sophomores enrolled at high school in Southern California, with a current Grade Point Average (“GPA”) of at least 3.0 at the time of entry. Entrants must get their parent or legal guardian’s permission to enter. The family members of officers, directors, and employees of Sponsor or Chargers Football Company, LLC (the “Chargers”) and their affiliated entities are NOT eligible to enter.
3.HOW TO ENTER: During the Entry Period, eligible entrants are invited to submit a 300-400 word essay (each, a “Submission”) answering the question “if you could visit any college, where would it be and why?” To enter, eligible entrants will submit their Submission and other requested information through a Google Form or other submission portal. Sponsor will include a link to the submission portal when it announces this Contest. If you did not see the announcement or otherwise need access to the submission portal, you can send an email to Bekah (firstname.lastname@example.org). Each Submission must be at least 300 words and no more than 400 words in length and must meet the following “Submission Requirements”: (i) the Submission must be the submitting entrant’s original, previously unpublished work; and (ii) the Submission must not be obscene, libelous or otherwise objectionable. Any Submission that, in Sponsor's discretion, violates the Submission Requirements may be disqualified. Submissions must be received by the end of the Entry Period. No substitutions or new versions of Submissions will be accepted once the original Submission is submitted. Personal information collected in connection with the Contest may be used in the context of the Contest (e.g., to pick a winners, highlight the winners and other notable entries, promote the Contest or similar contests conducted by Sponsor or the Chargers, and report on the winner and his or her Contest-related activities), and may be shared with the Chargers, which will use such information in accordance with its own privacy practices. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected Submission will be deemed ineligible. The Contest Entities assume no responsibility or liability for any error, omission, interruption, deletion, theft or destruction, or unauthorized access to, or alteration of entries.
4. WINNER SELECTION AND NOTIFICATION: At the end of the Entry Period, a panel of judges selected by Sponsor in its sole discretion (the “Judging Panel”) will select up to two (2) potential winners based on the following criteria: (i) quality of the Submission (1/3; (ii) creativity of the Submission (1/3) and (iii) factors related to the entrant’s transcript (1/3) (the “Judging Criteria”). Decisions of the Judging Panel are final and not subject to appeal. The potential winners will be notified using the contact information given at the time of entry. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by the potential winner for any reason. If any potential winner does not respond within the time required by Sponsor, or if the winner notification is returned as unclaimed or undeliverable to any potential winner, such potential winner will forfeit his or her prize and an alternate winner may be selected. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines the prize for any reason, such potential winner will be disqualified and the prize may be awarded an alternate winner.
5.PRIZES: Two (2) prizes are available. Each prize consists of a trip for the prize winner and one (1) parent and/or legal guardian to the college of their choice in the continental United States. The dates, destination, and other details of the trip will be coordinated between the Sponsor and each winner’s parent or legal guardian, but it is currently contemplated that each prize will include (i) round-trip coach-class airfare for the prize winner and his or her parent and/or legal guardian between the major airport that is nearest to the prize winner’s residence and the major airport that is nearest to the college selected by the prize winner (if the college in question is close enough to Los Angeles that a flight is not necessary, ground transportation may be provided); and (ii) hotel accommodations for the prize winner and his or her parent and/or legal guardian (one (1) room, double occupancy) at a hotel near the college selected by the prize winner; (iii) one (1) rental car or ground transportation; and (iv) a per diem for meals and incidentals. The total approximate retail value (“ARV”) of each prize will depend on the specifics of the trip. The winner’s travel companion must be his or her parent or legal guardian. Each winner and his or her parent/legal guardian must travel together on the same itinerary and must possess all required travel documents, and comply with any applicable hotel check-in requirements. A deposit or payment in advance, or presentation of a credit card by the prize winner, may be required at the time of check-in at the hotel. The prize may be subject to additional restrictions/conditions. The travel must be completed before any applicable college acceptance deadlines or it will be forfeited in its entirety. The rental car listed in the prize description will be provided only if the prize winner or his or her parent/legal guardian qualify under the rental car provider’s terms and conditions; otherwise, the rental car shall not be included in the prize that is awarded and the winner shall receive no alternative transportation or further compensation in lieu thereof. Other travel restrictions and blackout dates may apply.
6.GENERAL PRIZE CONDITIONS: Sponsor reserves the right in its sole discretion to substitute prizes of comparable value if any prize listed is unavailable, in whole or in part, for any reason. Prizes will be awarded only if the potential prize winner fully complies with these Official Rules. The prize(s) are non-assignable and non-transferable. All details and other restrictions of the prize(s) not specified in these Official Rules will be determined by Sponsor in its sole discretion. Each prize winner shall be solely responsible for all federal, state and/or local taxes, and the reporting consequences thereof, and for any other fees or costs associated with the applicable prize. Each potential winner will be required to execute an Affidavit of Eligibility, a Liability Release and where imposing such condition is legal, a Publicity Release (collectively, the “Prize Claim Documents”). The winner’s parent or legal guardian may be required to ratify and sign Prize Claim Documents. If any potential winner or such minor winner’s parent or legal guardian) fails or refuses to sign and return all Prize Claim Documents within the time period specified by Sponsor in the prize notification, the winner may be disqualified and an alternate winner may be selected. Sponsor makes no warranties, and hereby disclaims any and all warranties, express or implied, concerning any prize furnished in connection with the Contest.
7.REPRESENTATIONS AND WARRANTIES: Each entrant (and any minor entrant’s parent or legal guardian) represents and warrants as follows: (i) the Submission is the original work of the entrant; and (ii) the Submission does not violate or infringe upon the rights of any third party.
8.GRANT OF RIGHTS: For good and valuable consideration, the receipt and legal sufficiency of which is hereby acknowledged, each entrant into the Contest (and his or her parent or legal guardian, if the entrant is a minor) hereby grants Sponsor, its successors and assigns, and the Chargers, a non-exclusive license (but not the obligation) to reproduce, publicly perform, stream, exploit and otherwise use the Submission in perpetuity, for any reason whatsoever, including but not limited to advertising, marketing, publicity, promotion and exploitation of the the Contest, Sponsor, and the Chargers, without further notice to, consent by, or payment to entrant. Sponsor shall retain the rights granted in each Submission even if the Submission is disqualified or fails to meet the Submission Requirements.
9.PUBLICITY RELEASE: Sponsor and the Chargers and their affiliated companies and each of their respective officers, directors, members and employees are referred to as the “Contest Entities”. By participating in the Contest, in addition to any other grants which may be granted in any other agreement entered into between Sponsor and any entrant in and/or winner of the Contest, each entrant (and any minor entrant’s parent or legal guardian)grants the Contest Entities and their respective successors, assigns and licensees, the right to use such entrant’s name, photograph, likeness, statements, biographical information, and any other personal characteristics, in any and all media in connection with the Contest, and the advertising and promotion thereof and each entrant and/or prize winner (and any minor entrant’s or prize winner’s parent or legal guardian) hereby release the Contest Entities from any liability with respect thereto.
10.GENERAL LIABILITY RELEASE/FORCE MAJEURE: Each entrant (and any minor entrant’s parent or legal guardian) agrees that the Contest Entities (A) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Contest or any Contest-related activity, or from entrant’s acceptance, receipt, possession and/or use or misuse of any prize, and (B) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose. Sponsor assumes no responsibility for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Sponsor reserves the right to modify, extend, suspend, or terminate the Contest if it determines, in its sole discretion, that the Contest is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Contest as contemplated herein. In the event an insufficient number of eligible entries are received and/or Sponsor is prevented from awarding prizes or continuing with the Contest as contemplated herein by any event beyond its control, Sponsor shall have the right to modify, suspend, extend or terminate the Contest. If the Contest is terminated before the designated end date, Sponsor may (if possible) select the winner from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Only the type and quantity of prizes described in these Official Rules will be awarded. These Official Rules cannot be modified or amended in any way except in a written document issued in accordance with law by a duly authorized representative of Sponsor. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision.
11.ARBITRATION PROVISION: By participating in this Contest, each entrant (and any minor entrant’s parent or legal guardian) agrees that any and all disputes the entrant may have with, or claims entrant may have against, the Contest Entities will be resolved exclusively by final, private and binding arbitration administered by JAMS and conducted before a sole arbitrator in accordance with the rules of JAMS. 12.RELEASE AND DISCLAIMER. Each entrant (and any minor entrant’s parent or legal guardian) acknowledges and agrees that this Contest is not sponsored or administered by the Chargers. Any questions, comments or complaints regarding the Contest will be directed to the Sponsor and not to the Chargers.
13.WINNERS LIST/OFFICIAL RULES: To obtain a copy of these Official Rules or any legally-required winners list, send an email to email@example.com. All such requests must be received within six (6) weeks following the end of the Entry Period.
